When Congress passed the Agriculture Improvement Act of 2018 (a.k.a. the Farm Bill), it federally legalized hemp and hemp-derived compounds, as long as they contain no more than 0.3% Delta-9 THC by dry weight.

This legislation removed hemp from the Controlled Substances Act and opened the door for a variety of legal cannabinoids to be cultivated, extracted, and sold across the U.S.

What Is Hemp?

By legal definition, hemp is any part of the cannabis plant, including cannabinoids, extracts, and isomers, that contains less than 0.3% Delta-9 THC by dry weight. This makes it different from marijuana, which is still classified as a controlled substance if it exceeds that threshold.

How Are SipPuff Products Legal?

Our flower, edibles, vapes, and concentrates are all derived from hemp and fully comply with the Farm Bill. Many of the products we carry contain THCa, the raw, non-psychoactive form of THC that only becomes active (Delta-9) when heated, such as through smoking or vaping.

Because THCa is not considered Delta-9 THC in its raw form, and because our products remain within the 0.3% Delta-9 limit by dry weight, they are federally legal to ship and purchase.
